Heroes Of Lifemaan App
Welcome to Lifemaan, the platform designed to empower healthcare professionals in delivering quality care. These Terms and Conditions (“Terms”) govern your use of the Lifemaan’s mobile app (Heroes of Lifemaan) & web application and related services (collectively referred to as the “App”). By using the Lifemaan’s mobile App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. PROFESSIONAL ACCOUNT
1. Registration: To use the Lifemaan App, healthcare professionals must create a professional account. You agree to provide accurate, current, and complete information during the registration process.
2. Verification: Lifemaan reserves the right to verify the credentials and qualifications of healthcare professionals, as well as the documents pertaining to the location of their practice on the platform. Providing false information may lead to the suspension or termination of the professional account.
2. SERVICES OFFERED
1. Healthcare Services: Lifemaan enables healthcare professionals to offer a range of healthcare services, including but not limited to consultations, diagnostics, and other healthcare-related services.
2. Professional Conduct: Healthcare professionals agree to provide services in a professional and ethical manner, adhering to the highest standards of medical practice.
3. APPOINTMENT BOOKING
1. Appointment Acceptance: Healthcare professionals can accept or decline appointment requests made by users through the Lifemaan App. Timely responses to appointment requests are encouraged to enhance user experience.
2. Cancellation Policy: Healthcare professionals are responsible for adhering to the cancellation policy communicated to users through the Lifemaan platform.
4. FEES AND PAYMENT
1. Professional Fees: Healthcare professionals set their fees for services offered through the Lifemaan platform.
2. Payment Processing: Lifemaan facilitates payment processing for services rendered by healthcare professionals. Fees are subject to the agreed-upon payment terms.
3. Payment Responsibility: You are solely responsible for the payment of all taxes, legal compliances, statutory registrations, and reporting related to your use of the Lifemaan App. Lifemaan holds no responsibility for any taxes other than its own income tax.
4. Online Fees Payment: The fees for Lifemaan services can be paid online through the facility provided on the Application. Third-party support and services may be utilized to process online fee payments. Lifemaan is not responsible for any loss or damage caused to users during this process, as these third parties are beyond the control of Lifemaan.
5. Fee Variation: While Lifemaan will strive to provide you with a fair estimate of fees in advance, please note that the actual fees may vary based on the type and quantity of services selected.
6. Refunds: Refund policies, if applicable, will be outlined in the Refund Policy section. Users are encouraged to review and understand the refund policy before making any payments.
7. Third-Party Payment Processing: The Lifemaan App may use third-party services for payment processing. Your use of such third-party services is subject to their terms and conditions. Lifemaan is not responsible for any issues or disputes arising from transactions processed by third-party payment providers.
8. Currency and Conversion Fees: If applicable, currency conversion fees and additional charges imposed by financial institutions for transactions conducted in foreign currencies are the responsibility of the user.
9. Changes to Fees: Lifemaan reserves the right to change its fee structure and payment policies at any time. Users will be notified of such changes, and continued use of the Lifemaan App after notification constitutes acceptance of the modified fee structure.
5. PRIVACY AND CONFIDENTIALITY
1. Patient Information: Healthcare professionals acknowledge the importance of patient confidentiality. All patient-related information obtained through the Lifemaan platform must be treated with the utmost confidentiality and used solely for providing healthcare services.
2. Data Security: Lifemaan is committed to maintaining the security of user and professional data. Healthcare professionals must take appropriate measures to safeguard patient information.
6. Use of the App
1. Compliance: You agree to use the App in compliance with all applicable laws and regulations.
2. Prohibited Conduct: You may not use the App for any unlawful or prohibited purpose. This includes, but is not limited to, transmitting any harmful code, engaging in disruptive activities, or violating the rights of others. You as a Registered User will use the Application solely for Your personal and professional use. Any use of this Application or its content other than for personal and professional purposes is strictly prohibited.
7. PROFESSIONAL LIABILITY
1. Professional Responsibility: Healthcare professionals are solely responsible for the medical advice and services provided through the Lifemaan platform.
2. Indemnity: Healthcare professionals agree to indemnify and hold Lifemaan harmless from any claims, damages, or liabilities arising from their services.
8. PROFESSIONAL LISTINGS
1. Information Collection and Display: Lifemaan collects information regarding healthcare professionals’ profiles, contact details, and practice. Lifemaan reserves the right to display or take down any professional’s profile, with or without notice to the concerned professional. If any information displayed on the Lifemaan App in connection with you and your profile is found to be incorrect, you are required to inform Lifemaan immediately to enable necessary amendments.
2. Ranking on External Platforms: Lifemaan shall not be liable or responsible for the ranking of healthcare professionals on external websites and search engines.
3. User Consent and Disclosures: Lifemaan shall not be responsible or liable in any manner to users for any losses, damage, injuries, or expenses incurred by users as a result of any disclosures or publications made by Lifemaan, where the user has expressly or implicitly consented to the making of disclosures or publications by Lifemaan. If the user has revoked such consent under the terms of the Privacy Policy, then Lifemaan shall not be responsible or liable for any losses, damage, injuries, or expenses incurred by the user as a result of any disclosures made by Lifemaan prior to its actual receipt of such revocation.
4. Content Moderation: Lifemaan reserves the right to moderate the information and suggestions made by healthcare professionals through feedback and has the right to remove any abusive, inappropriate, or promotional content added on the Lifemaan App. However, Lifemaan shall not be liable if any inactive, inaccurate, fraudulent, or non-existent profiles of healthcare professionals are added to the Lifemaan platform.
5. Content Publication to Third Parties: Healthcare professionals explicitly agree that Lifemaan reserves the right to publish the content provided by healthcare professionals to third parties, including content platforms.
6. Professional Conduct and Ethics: Healthcare professionals agree to maintain the highest standards of professional conduct and ethics while utilizing the Lifemaan platform. Any violation of professional standards may result in the removal of the professional’s profile from the Lifemaan App.
7. Accuracy of Information: Healthcare professionals are responsible for ensuring the accuracy of the information provided on their profiles. Lifemaan shall not be held responsible for any inaccuracies in professional profiles.
8. Professional Image and Branding: Healthcare professionals agree to present accurate and professional information on their profiles. Lifemaan reserves the right to remove content that does not adhere to professional standards or violates ethical guidelines.
9. DESCLAIMERS
1. Suspension or Termination: Lifemaan reserves the right to suspend or terminate the professional account of healthcare professionals for violation of these Terms or any other reason without prior notice.
2. Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Gujarat, India. Any disputes arising under or in connection with these Terms shall be resolved in the courts of Surat, Gujarat, India.
3. Updates to terms: Lifemaan reserves the right to update or modify these Terms at any time without prior intimation or notice. Healthcare professionals will be notified of changes, and continued use of the Lifemaan App after notification constitutes acceptance of the modified Terms. Please refer to Privacy Policy as well.
4. Severability: If any provision of these Terms and Conditions is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be considered severed from these Terms, and the remainder of the Terms shall be interpreted as if such provision were excluded. The remaining provisions of the Terms shall remain in full force and effect. In the event of such severance, the Terms shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.

However, the actual fee may depend on the type of services you purchase and may vary based on the number or duration of the services subscribed to.

6. Physical consultation appointment booking
1. Confirmation of Appointments: Lifemaan facilitates Users to book physical consultation appointments with healthcare professionals through the App. Lifemaan will ensure Users are provided with a confirmed appointment for physical consultations. However, Lifemaan holds no liability if such an appointment is later cancelled by the healthcare professional, or if the same healthcare professional is not available for the appointment.
2. Practitioner Availability: While Lifemaan strives to provide accurate and up-to-date information regarding practitioner availability, changes may occur. Users are advised to check the latest availability of healthcare professionals before booking a physical consultation appointment.
7. Video consultation appointment booking
1. Booking Video Consultations: Users can book video consultations with healthcare professionals through the Lifemaan App. Lifemaan aims to provide a seamless experience for Users seeking medical advice through video consultations.
2. Information Sharing: By utilizing the video consultation services, Users acknowledge that Lifemaan reserves the right to share the information provided by the User with the healthcare professional and store such information and/or conversation of the User with the healthcare professional, following the guidelines outlined in the Lifemaan Privacy Policy.
3. Privacy and Confidentiality: Lifemaan is committed to maintaining the privacy and confidentiality of Users’ information shared during video consultations. The details of the privacy and confidentiality policy can be found in the dedicated section within the Lifemaan App.
4. Results of Search: The results of any search performed on the Lifemaan App for healthcare professionals should not be construed as an endorsement by Lifemaan of any particular healthcare professional. If the User decides to engage with a healthcare professional for medical services, the User shall be doing so at his/her own risk.
5. User Responsibility: Users are responsible for providing accurate and truthful information during the booking process and video consultations. Lifemaan holds no responsibility for the consequences arising from inaccurate or false information provided by Users.
6. Disclaimer: Lifemaan does not endorse or guarantee the accuracy of healthcare advice provided during video consultations. Users are encouraged to seek in-person medical advice for a comprehensive evaluation of their health condition.
8. Health Information
1. Accuracy: Lifemaan does not guarantee the accuracy, completeness, or reliability of health-related information provided on the App. Consult with healthcare professionals for accurate and personalized advice.
2. User-Generated Content: Users may submit health-related content. Lifemaan is not responsible for the accuracy or reliability of user-generated content.
9. Disclaimers
1. No Warranty: The App is provided “as is” and without warranties of any kind, either expressed or implied.
2. Representations: You are 18 years of age or older and that Your use of the Application shall not violate any applicable law or regulation; Where a minor may access or use the Application or Service, You will ensure that such access or use happens through Your account and under Your personal supervision. Further, You accept to be accountable and liable for the activity of the minor on the Application, including in respect of the Services availed on the Application.
3. Limitation of Liability: Lifemaan and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the App.
10. Modification of Terms: Lifemaan reserves the right to update or modify these Terms at any time without prior intimation or notice. Users will be notified of changes, and continued use of the App constitutes acceptance of the modified Terms.
11. Termination: Lifemaan reserves the right to suspend or terminate your access to the App at any time, for any reason, without notice.
